Section 103
Accused accused of one offense may be punished for another offense
(1) The military court may convict and punish the accused accused of the following offences:-
(a) For the offense of attempting to escape or of absconding, the person accused of being a fugitive,
(b) in the offense of absconding the person charged with attempting to escape,
(c) in the offense of assault on a person charged with using a criminal weapon,
(d) In the offense of intimidation against a person accused of using the word of threat,
(e) A person charged with an offense under clause (a) or (b) of section 49 for an offense under clause (c) of the same section.
(2) If it is not proven that the accused who has been charged with any offense under this Act has committed the offense under circumstances that would be punishable by severe punishment, the military court may award a lesser punishment by assuming that the offense was committed under normal circumstances.
(3) A military court may punish an accused who has been charged with an offense in accordance with this Act as having committed or conspired to commit such an offence, even if he has not been charged separately.
